Diyar Mobil Terms of Use

1. Parties and Subject of the Agreement

These Terms of Use ("Agreement") are drawn up between the person downloading, using, or visiting the Diyar Mobil application ("Application") and the website www.diyarmobilapp.com (collectively referred to as the "Platform") ("User") and the developer and operator of the Platform, DELTA ARAŞTIRMA VE YAPAY ZEKA TEKNOLOJİLERİ ("Developer" or "Diyar Mobil Developer Team") to determine the terms of use of the Platform and the rights and obligations of the parties.

From the moment the User accesses the Platform (website or application) and checks the "I have read and accept the Terms of Use" option (or continues to use the site), they are deemed to have fully accepted all articles of this agreement. If you do not agree to the terms, please stop using our website and uninstall the Application from your device.

2. Rights and Obligations of the User

While using the Platform, the User agrees to comply with all applicable legal regulations, general rules of morality, and principles of honesty. In this context:

• User-Generated Content: The accuracy of the information shared by the User in modules such as traffic, radar, accident reports, or anonymous voting is entirely the responsibility of the User. Road condition information, whether correct or incorrect, existing or non-existing, is entirely provided by the community; the Developer cannot be held liable for any situation that may arise.
• Safe Driving and Compliance with Traffic Rules: Road Status (radar / checkpoint / accident) reports are for information only. They do not encourage exceeding speed limits, violating traffic rules, or obstructing the lawful duties of law enforcement officers, and must not be used for such purposes. The User agrees not to use their device while driving (and to stop in a safe place before leaving a report) and to obey traffic rules. All criminal, administrative, and legal liability arising from use contrary to these rules rests with the User.
• No Affiliation with Public Authorities: Road Status reports are created and verified solely by Users. They do not come from the police, gendarmerie, municipality, or any other public authority; there is no affiliation or cooperation with such bodies, and the reports are not official information.
• Prohibited Reports: Reports that are untrue or misleading, or that are intended to harm others or to cause false alarms concerning law enforcement or public officials, are prohibited. Report types are predefined; free text, photos, or personal information cannot be shared on the Platform.
• Notice and Removal Requests: Anyone who believes a Road Status report is incorrect, misleading, or unlawful may contact info@diyarmobilapp.com. Once a request containing information that reasonably shows the unlawfulness is received, the Developer reviews the report and removes content it determines to be unlawful without delay. Reports are also deleted automatically after 2 hours at the latest and can be removed by community vote.
• Spam and Abuse: Intentionally adding misleading notifications on the map (fake accident, fake radar, etc.), attempting to manipulate the system (interfering with votes via bots or automation), or carrying out bot attacks that overload the servers is strictly prohibited.
• System Limits and Quotas: Certain features within the Platform are limited by daily usage quotas (e.g., a maximum of 3 messages per day) due to server capacities and sustainability. The Developer reserves the right to change these quotas or completely shut down the feature without prior notice.
• Right of Sanction: The Developer reserves the right to restrict or completely block (ban) the access of devices or IP addresses found to have abused the system or entered misleading information to the Platform without prior notice.

3. "As-Is" Provision of Service and Disclaimer of Liability

The Platform is provided on an "as-is" and "as-available" basis. The Developer makes no express or implied warranty that the Platform will be uninterrupted, error-free, or completely secure.

• Taxi Fares and Stands: The taxi fare calculation module provides an estimated calculation based on an average value per kilometer. The Developer accepts no responsibility for any errors or fare disputes that may occur. Taxi stands are compiled from Google and other public sources. Non-existent stands cannot claim any rights; the numbers and names of the stands found in the system are shared completely free of charge for public benefit. No responsibility is accepted in any dispute.
• Food-Beverage Venues and Pharmacies: Information such as address, phone, name, and star rating belonging to food and beverage venues is pulled from Google Maps; pharmacies on duty and bus schedules are pulled from external APIs. The Developer is not responsible for any grievances arising from missing, incorrect, or outdated information in the data. Business and stand owners can contact us through our communication channels to remove or edit their information on the platform.
• Weather and Markets: Weather and financial/market (gold, silver, currency) data are pulled instantly from external APIs. The Developer accepts no responsibility in the event of a possible delay or inaccuracy in this data.
• Cultural Heritage and City Guide: The information written in the cultural heritage area and guide is entirely for informational purposes. No responsibility is accepted in case of minor overlooked informational inaccuracies or omissions.
• Map, Traffic, and Radar Data: Traffic conditions and radar notifications within the Platform are provided by User notifications. The accuracy, timeliness, or completeness of reports is not guaranteed; the absence of a report at a location does not mean there is no checkpoint, radar, or accident there. The Developer cannot be held liable for traffic fines, delays, or accidents that may occur due to missing or incorrect radar/traffic notifications. The User must comply with applicable traffic legislation at all times.
• Website Accessibility: Server outages, slowdowns, or planned/unplanned maintenance are not the responsibility of the Developer.

4. Diya Ai (Artificial Intelligence) Terms of Use

The "Diya Ai" assistant within the Platform operates using third-party artificial intelligence language models (e.g., OpenAI). The User using the assistant accepts the following terms in advance:

• Data Processing and Transfer to Third Parties: Questions and messages written by Users to Diya Ai are transmitted anonymously to third-party artificial intelligence service providers to generate answers. The User is obliged not to share their National Identity Number, credit card, or sensitive personal data.
• Security and Log Records: In order to ensure system security and prevent bot (spam) attacks, the User's IP address and daily usage frequency are logged on our servers for security purposes. In addition, the text of your message and its topic/intent may be recorded without identity details to measure service quality; details are in the Privacy Policy.
• No Advisory Nature and Disclaimer of Liability: The answers provided by Diya Ai are entirely for informational and entertainment purposes, artificial intelligence systems may produce "hallucinations" (false information). No answer given by Diya Ai constitutes legal, medical, financial, or professional advice. The Developer cannot be held liable for any material/moral grievances and damages experienced by individuals acting on the advice given by Diya Ai, incorrect routes, or directions to closed businesses.

4/A. Advertising, Sponsored Content, and Age Limit

• Advertising: The Platform is free and supported by advertising. Ads are served by a third-party ad network (Google AdMob); the Developer is not responsible for the content of ads or for advertisers' products and services. You can limit ad personalization in your device settings (details are in the Privacy Policy).
• Sponsored and Featured Content: Some businesses and campaigns may be shown on the Platform as sponsored or featured. The relevant business is responsible for the accuracy of such content; the Developer is not a party to any purchase or dispute between a business and a User.
• Age Limit: The Platform is not designed for children under 13. Users under 18 should use the Platform with the knowledge and supervision of a parent or guardian.
• Termination of Access: The User may stop using the Platform at any time by uninstalling the application. The Developer may restrict access in case of breach of these Terms or on the grounds of changing or discontinuing the service.

5. Third-Party Services and Links

The Platform uses external links (APIs) for services such as news sources, sports data providers, map directions (Google Maps/Apple Maps), and weather. The Developer is not responsible for the content, privacy policies, or service interruptions of these third-party systems.

6. Intellectual Property Rights

All software codes, designs, visual identity, algorithms, database structures, logos, and the "Diyar Mobil" and "Diya Ai" brand names (except those belonging to third parties) of the Platform (Application and www.diyarmobilapp.com) exclusively belong to the Developer. Everything including our brand's name, design, and identity is reserved. They cannot be copied, reproduced, reverse engineered, sold, or used for commercial purposes without the written permission of the Developer.

6/A. Additional Provisions

• Emergencies: The Platform is not an emergency service. In emergencies such as accidents, fires, or medical or security incidents, call the 112 Emergency Call Center; Road Status reports and Diya Ai are no substitute for emergency help.
• Routes and Transport Information: Public transport routes, walking directions, and distance and time figures are estimates and may not reflect road, line, or schedule changes. The User must obey road signs and the instructions of law enforcement on the ground.
• Relationship with Third Parties: Institutions, clubs, businesses, or news sources named on the Platform (e.g., sports clubs, local press, municipality and public bodies) are not necessarily affiliated with, represented by, or in cooperation with the Developer; their trademarks and logos belong to their owners and are mentioned for informational purposes only.
• Prohibited Use: It is prohibited to reverse engineer the Platform's software, harvest its data with automated tools (scraping), circumvent its security measures, use the service in violation of others' rights or applicable law, or copy and republish it for commercial purposes.
• Rights in User Reports: The User permits the reports they make in Road Status to be shared with other users and processed within the Platform, and to be used free of charge and without time limit for anonymous statistical purposes.
• Force Majeure: No liability is accepted for disruptions caused by events beyond the Developer's control, such as natural disasters, war, epidemics, or infrastructure or third-party service outages.
• Severability: If any provision of these Terms is held invalid, the validity of the remaining provisions is not affected.

7. Amendments to the Agreement

The Developer has the right to unilaterally change these Terms of Use at any time, without prior notice, due to legal requirements, newly added features, or technical necessities. The updated agreement is deemed valid from the moment it is published on the Platform. By continuing to use the Platform, the User is deemed to have accepted these changes.

In any dispute that may arise from this agreement, the laws of the Republic of Turkey are applicable, and the competent authorities are the Courts and Enforcement Offices of the Republic of Turkey.
